What is a Status Certificate?

回答:公寓管理文件是共管公寓公司详细阐述当前特定单元现状的一份报告。公寓管理文件通常是由物业主出具的。除了物业主可能欠的公寓管理费的信息之外, 公寓管理文件通常还包括 声明书,公司章程细则,公寓规章制度,财务账单,预算,保险证书以及 工程调查的副本。

A Status Certificate is a report from the Condominium Corporation that gives details about the current state of any particular unit.  A Status Certificate is typically produced when an owner wishes to sell their unit.  In addition to information about common element fees and money that may be owed by the owner, the status certificate normally also includes a copy of the Declaration, the By-Laws, the rules of the condominium, a financial statement, a budget , an insurance certificate and an engineering study.

A Declaration is a registered document that creates the condominium.  It includes the legal description of the condominium, what is a part of a unit and what is a part of common elements, and the main rules of the condominium.

By-laws are also registered documents.  They may address any number of issues, but generally, they address the general procedures of the condominium, the right to borrow for the condominium, and the assumption of any development or other agreements by the Condominium Corporation.

问题#6: 谁来审核公司管理文件?

Who reviews the Status Certificate?

回答:任何人都可以审核公司管理文件,但是在大多数交易中,是由买方律师来审核管理 文件。如果存在问题,在可能时,可以通过修改买卖协议来解决。

Anyone can review a Status Certificate, but in most transactions, it is will be the buyer’s real estate lawyer that reviews the status certificate.  If there are issues, then they will have to be addressed by amending the agreement of purchase and sale if possible.
