问题#13: 律师做产权调查时要做哪些事?

What is my lawyer doing when he does a title search?

回答:律师做产权调查时,除了检查房产所有权和调查现有的房产欠债以外,还要调查周边相连的房产;要审核已经注册的平面图,以便确定房产的大小和地理位置;以及检查房产的相关法律描述和其他注册的文件,以确定将来你对房产的使用是否有任何限制。

Title searching is more than just checking ownership and looking for existing encumbrances.  It also includes checking adjacent properties to see if there are any inconsistencies, reviewing registered plans or maps of the property to confirm size and location and checking the legal description and other registered instruments to determine if there are any limits to the use of the property.

问题#14: 当律师向我解释房产所有权的时候,我希望从律师那里知道什么?

What I expect from my lawyer when they explain title to me?

回答:你的律师应该向你解释房产产权调查的结果。包含解释一份已经注册的产权平面图,指出房产的大致占地尺寸,以及你对你的房产拥有的使用,维护和任何限制的权利, 和可能其他人对你的房产拥有的权利。

The results of the title search should be explained to you.  You should expect a review of any registered plans or maps, the approximate size of the property, any rights you may have for access and maintenance, any restrictions with respect to what you can do with your property, and any rights that others may have over any portion of your property.

问题#15: 如果我没有房屋图纸 ,产权调查会告诉我房产的大小吗?

If I don’t have a survey, can a title search show me the size of my property?

回答:大多数新的无管理费房产都是通过一份注册的住宅小区平面图和一份注册的参考平面图来建造。这两份文件会显示房产的大小。对旧的房产而言,可能只有书面的法律描述说明房产的大小。通常律师可以根据这个法律可能只有书面的法律描述来绘制一个图表,让你知道你的房产的大致大小。

Most newer freehold properties are created by way of a registered plan of subdivision and a registered reference plan.  Both of these documents will show the size of the property.  Further, for older properties, there may only exist a written legal description.  By drawing a diagram in accordance with that description, you can determine the approximate size of the property as well.
