Jon Corzine, former MF Global CEO, is expected to complete his third round of testifying to separate commissions on Capitol Hill today with his appearance at the House Financial Services Committee today. Last week he was at the House Agriculture Commission and on Tuesday at the Senate Agriculture Committee … neither hearing yielded much information about who was responsible for the commingling of client funds within MF Global, or where the missing money (ranges from $200 million to $1.6 billion) is located. Although there were indications that Corzine knows a bit more than he is telling by disclosures on Tuesday by CME Group Inc. Executive Chairman Terrence Duffy that Corzine “might” have known that MF Global used clients’ money to lend to a European affiliate of the firm. Most experts thought that Corzine would not say anything in these hearings other than state that he was taking the 5th (Amendment to protect a person’s rights to not self incriminate by answering questions (aka saying something stupid that would come back to haunt them later)). However, Corzine has kept talking at these hearings but he is providing very little information and denying that he knows much of anything about how business was conducted at the firm he headed. In an opening statement last week before the House Agriculture Committee, Corzine said that he “never intended to break any rules” and that since he left MF Global (November 4) he has not had access to his notes (left back at the office) to answer questions about what happened in the last days of MF Global before filing for bankruptcy. Regarding news of discovering that funds were missing at MF Global, Corzine said he was, “stunned”. Well, his clients were “pissed” at the revelation. It has been disturbing to watch these hearings and see the former MF Global Chief Executive, Jon Corzine, COO Bradley Abelow and CFO Henri Steenkamp, insist that they know nothing (The Sergeant Shultz defense). Clients want answers, and they would have received more answers from the executives had they all just taken the 5th (not talked) than added to the confusion by answering “No, No, No” to questions regarding their involvement in taking customers funds and missing money. I think the public would have drawn comfort that these executives were not talking to protect their covert actions, rather than their talking and saying that they did not know much of anything about running a multi-billion dollar, publicly traded financial institution. Frightening. The statements made by Corzine make for a good strategy to avoid criminal prosecution, but it is a pitiful stance to take at a time when the general public so distrusts many of our financial institutions. Don’t set your expectations high for testimony today. Even with the disclosure that “Corzine” may have known about certain transfers of client funds, he will defer to not recalling or leaving his notes back at the office. I think we would all be happy if the executives would just give us a name of anyone who was responsible for anything at MF Global….we can start an investigation from there.
